Reconsideration
Reconsideration is an internal review of a decision the OSC has made. Find out how it works.
What is reconsideration?
Reconsideration is a process where the OSC reviews its original decision. The OSC may consider any new information provided in the reconsideration application.
What decisions can the OSC reconsider?
The OSC may reconsider:
A direction
An order following non-compliance with a direction
A decision not to give a direction
Who can apply for reconsideration?
You may apply for reconsideration if you are:
The victim in a report to the OSC, or their authorised representative, and want the OSC to review its decision on that report
The recipient of a direction or an order from the OSC
A person affected by an OSC direction, such as where the direction covers material you shared online or an online account you own
Time limit to apply
You must apply within 14 days of the OSC’s decision, direction, or order.
If more than 14 days have passed, you will need to:
Explain why you are applying now, and
Provide evidence to support your reasons for the late application
What to provide in your application
You will need to provide:
The OSC case reference number for the decision you want reconsidered. This enables the OSC to locate and retrieve information relevant to your application.
The reasons why you are applying.
Declaration that any information you provided is true. Please note that making a false declaration is an offence.
Any other documents or materials that can support your application.
Important things to know
An application for reconsideration does not suspend any OSC direction or order.
The OSC will assess each application carefully. Submitting an application does not guarantee that the OSC will change its decision.
The OSC may contact you if more information is needed.
Want to be contacted if someone else asks for reconsideration in your case?
You may still provide your contact details to the OSC even if you do not wish to apply for reconsideration. The OSC may contact you if someone else applies for reconsideration in a case concerning you.
